A spokesman for the Albany Roman Catholic diocese says it's the first time in 38 years that files have to be turned over for any priests, who have been implicated in cases of clergy sexual abuse. A U.S. district judge has ordered the diocese to turn over files to a man from Warren County, a man who said he was raped and abused in New York, Massachusetts and Vermont when he was an 8 year old alter boy, by Gary Mercure. Mercure was a priest in the Albany Roman Catholic Diocese from 1974 until his removal in 2008. He was convicted in Massachusetts, and sentenced in 2011 to up to 25 years in prison, for raping two alter boys. The Times Union is reporting that one of the alter boys was the alleged victim in the Vermont case. The judge has ordered those files sealed.
